By downloading, installing, purchasing, or using Kepler, you agree to these Terms. Please read them carefully.
1. Acceptance
These Terms govern your use of Kepler and this website, operated by Leonhard Breuer, Germany ("we", "us"). If you do not agree, do not use Kepler.
2. License
We grant you a personal, non-transferable, non-exclusive license to install and use Kepler on Mac devices you own or control.
Unless explicitly stated otherwise, a Kepler license is a lifetime license to use Kepler. Any future updates we release for the same Kepler product line are included at no additional cost.
However, a lifetime license does not guarantee that Kepler will receive new features, major upgrades, or updates forever. We may continue, change, pause, or discontinue development and update services at our discretion.
Kepler may require a specific minimum macOS version. Compatibility with all future versions of macOS, hardware, third-party services, or system APIs is not guaranteed indefinitely.
Nothing in these Terms limits any mandatory rights you may have under applicable consumer protection law, including rights relating to required security, compatibility, or conformity updates.
You may not:
- Copy, modify, or distribute Kepler except where permitted by law
- Reverse engineer, decompile, disassemble, modify, or tamper with Kepler, except where such activity is expressly permitted by applicable law
- Circumvent license checks, create or use unauthorized license keys, bypass access restrictions, remove copy protection, or distribute modified copies of Kepler
- Use Kepler for any unlawful purpose
- Sublicense, rent, lease, or sell access to Kepler
3. Early access
Kepler may be offered as early access or pre-release software. Early access versions may contain bugs, incomplete features, breaking changes, or functionality that changes or is removed before or after the 1.0 release.
We currently intend to allow early access users to keep using Kepler after the 1.0 release. However, early access does not guarantee access to all future paid features, major upgrades, cloud services, commercial add-ons, or separately offered products unless explicitly stated otherwise.
4. Third-party plugins
Kepler may allow you to install, enable, or use plugins created by third parties. Third-party plugins are created and maintained by independent developers and are not part of Kepler unless explicitly stated otherwise.
Third-party plugins may access local data, perform network requests, execute code, or interact with external services depending on their functionality. You are responsible for deciding which plugins you install and enable.
We do not control, endorse, or guarantee the functionality, security, legality, availability, or privacy practices of third-party plugins. To the fullest extent permitted by law, we are not responsible for damage, data loss, security issues, privacy issues, or other problems caused by third-party plugins.
5. Intellectual property
Kepler and all related materials, including the name, logo, design, and code, are owned by Leonhard Breuer and protected by applicable intellectual property law. Nothing in these Terms transfers any ownership to you.
6. Disclaimer of warranties
Kepler is provided with reasonable care. However, except as required by applicable law, Kepler is provided without warranties that it will be error-free, uninterrupted, or suitable for every specific purpose.
7. Limitation of liability
We are fully liable for intent and gross negligence, and for injury to life, body, or health. We are also liable where liability cannot be limited under applicable law.
In cases of ordinary negligence, we are only liable for breaches of essential contractual obligations. In such cases, liability is limited to typical and foreseeable damages.
To the fullest extent permitted by law, we are not liable for indirect damages, loss of profit, loss of data, or damage caused by third-party plugins, third-party services, or user-installed components outside our control.
8. Termination
We may suspend or terminate access to Kepler if you materially violate these Terms, misuse Kepler, or use it unlawfully. This includes modifying, distributing, cracking, circumventing license checks, creating or using unauthorized license keys, or reverse engineering Kepler in a way that is not permitted by applicable law.
Upon termination, your license to use Kepler ends.
9. Governing law
These Terms are governed by the laws of Germany. If you are a consumer, mandatory consumer protection laws of your country of residence remain unaffected.
10. Changes
We may update these Terms from time to time. Changes will be posted on this page with an updated date. Material changes will not affect licenses already purchased unless required by law or necessary for security, compatibility, or continued operation.
